Manifestation Determination Procedural Guidelines
Purpose:
Within 10 school days of any decision to change the placement of a student eligible for special education because of a violation of a code of student conduct, the school district, the parent, and relevant members of the student’s IEP team (as determined by the parent and the school district) must review all relevant information to determine if the conduct in question was caused by, or had a direct, substantial relationship to, the student’s disability; or if the conduct in question was the direct result of the district’s failure to implement the IEP.
District Procedures:
(a) Principal or other building administrator calls the parents and sends home a discipline letter and Procedural Safeguards.
(b) IEP case manager contacts parents and arranges a date and time for a manifestation meeting. (Meeting Notice and a PWN)
(c) Manifestation meeting is facilitated by the school psychologist or the IEP case manager. In attendance should be LEA representative (school psychologist can fill this role), special education teacher/IEP case manager, one general education teacher, parent and student.
Principals and other administrators can attend if they are regular members of the IEP team.
(d) Administrators can meet with the student and family afterwards to discuss the discipline action to be taken once they have the IEP team decision.
(e) If the behavior was not a manifestation of the disability
(i) General education discipline applied
(ii) The IEP team determines if an Alternative Education Site (AES) is needed and the services to be provided to the student during this time(iii) IEP case manager would have a meeting to amend the IEP to reflect the alternative setting (Meeting notice, PWN, and
amendment)
(iv) Meeting needs to take place within 10 days of the decision to change placement
(f) If the behavior was a manifestation of the disability:
(i) FBA and BIP need to be reviewed/modified or conducted
(ii) Because of drugs and weapons, if the student will be out of school for over 10 days,
the IEP team would determine an AES as above and follow the same procedures.
Need to work on how we will do tutoring requests if students need an AES
